LALIVE partner Simone Nadelhofer and associate Adam El-Hakim co-authored the article «Compliance im Zentrum des Unternehmensstrafrechts» (Compliance at the heart of corporate criminal law) published in «Recht relevant. für Compliance Officers 5/2022».

The key to reduce the risk of a company’s criminal liability is a clearly defined and functioning governance, effective procedures and functioning control-mechanisms. The authors shed light on the respective prerequisites and measures developed in Swiss case law.

Simone Nadelhofer specialises in complex international white-collar crime investigations and internal investigations. She is a member of several professional associations, including the Advisory Board for the project of the Swiss National Scientific Fund “Assessing the nature and impact of transnational corruption through the lens of Swiss Businesses,” the ACi ISO Subcommittee for the new ISO standard on internal investigations, the Swiss Association of Experts in Economic Crime Investigation, the Zurich and Swiss Bar Association and the European Criminal Bar Association (ECBA). She is Corporate Counsel Forum Liaison Officer of the IBA’s Business Crime Committee, Past Chair of the Anti-corruption and the Rule of Law Committee at the Inter Pacific Bar Association (IPBA) and a member of the advisory board of the Master Economic Crime Investigations studies at the Lucerne University.

Adam El-Hakim specialises in complex international white-collar crime investigations and mutual legal assistance in criminal matters. He is a founding member and chairman of the Private Claimants Network (PCN) / Netzwerk Privatklägerschaft (NPK) and a member of several professional associations, including the European Criminal Bar Association (ECBA) and the European Fraud and Compliance Lawyers (EFCL).
