Marc Henzelin a rejoint LALIVE en 2001 et est associé de l’Etude. Il bénéficie d’une vaste expérience en contentieux transnational et national, et plus particulièrement en droit pénal international et économique, en contentieux commercial et bancaire, en recouvrement d’actifs, en entraide internationale en matière pénale et d’extradition, ainsi qu’en droit du sport et en droit international public. Il dirige aussi régulièrement des enquêtes privées, notamment dans les domaines de recherche et recouvrement d’actifs, ainsi que sur des questions de conformité.
Me Henzelin était juge suppléant à la Cour de cassation de Genève (2009-2011) et a également occupé le poste de juge suppléant à la Cour de justice de Genève au sein des chambres criminelle et commerciale (2002-2009). Il est l’un des fondateurs et co-directeurs de l’établissement aujourd’hui connu sous le nom de l’Académie de droit international humanitaire et de droits humains (ADH, https://www.geneva-academy.ch/).
Il est membre de nombreuses associations professionnelles, dont la section Double Jeopardy Subcommittee au sein du comité anticorruption ainsi que la section Business Crime (dont il a été co-président de 2010 à 2012) de l’International Bar Association (IBA), du comité consultatif de la European Criminal Bar Association (ECBA) depuis 2007, et de la commission anticorruption de la Chambre de commerce internationale (CCI).
Marc Henzelin est recommandé par l’International Who’s Who of Business Crime Lawyers, Chambers Europe (White Collar Crime) et par l’Expert Guide comme un des meilleurs spécialistes de Suisse en droit pénal économique. Il est également recommandé en matière de recouvrement d’actifs (asset recovery), de droit pénal économique (business crime defence) et d’intelligence économique (investigation) par le Who’s Who Legal Switzerland, ainsi qu’en contentieux par le Legal 500.
Me Henzelin est également membre du comité de rédaction du New Journal of European Criminal Law (auparavant Journal of European Criminal Law, NJECL) et du Global Investigations review (GIR) . Il a publié de nombreux ouvrages et articles et donné de nombreuses conférences en matière de droit pénal international et économique, droit de l’entraide internationale en matière pénale, contentieux et droit public international. Depuis 1995, il occupe diverses positions académiques dans des universités suisses (dont l’Université de Genève) et étrangères (Turin, Hong Kong, Paris, etc.).
Avant de rejoindre LALIVE, Me Henzelin a exercé comme avocat à Lausanne et à Genève. Auparavant, il a été conseiller juridique / coordinateur pour le Comité international de la Croix-Rouge au Mozambique (1987-88), en Israël / Liban / Territoires Occupés (1988-89) et en Afrique du Sud (1990-92).
Marc Henzelin est diplômé de l’Université de Genève (1984) et a étudié à la Faculté des sciences économiques de l’Université de Berne (1985). Il est également titulaire d’un Master in European Legal Studies (LL.M.) délivré par l’Université d’Exeter, Royaume-Uni (1993) et d’un doctorat de droit de l’Université de Genève (1999, summa cum laude, prix Edgar Aubert pour la meilleure thèse de droit public pour les années 1999-2000).
