LALIVE defeats challenge to arbitral award for GreenX

The firm is proud to have secured a victory for subsidiaries of GreenX Metals Ltd (previously known as Prairie Mining) in defeating a challenge brought by the Republic of Poland before the Singapore International Commercial Court (SICC).

As reported by GreenX, the SICC dismissed the challenge in its entirety. The challenge relates to a unanimous arbitral tribunal decision from October 2024, which held that Poland had breached its obligations under the Energy Charter Treaty, with respect to the Jan Karski coking coal project in the southeastern Lublin province. The tribunal issued a parallel award under the Australia-Poland Bilateral Investment Treaty. GreenX was awarded approximately US$330 million, including accrued interest at the time, in total across the two proceedings. Poland’s challenge to the parallel award under the Australia-Poland Bilateral Investment Treaty is currently pending before the English High Court.
